AN ORDINANCE OF THE CITY OF EDGEWOOD, IN KENTON COUNTY, KENTUCKY, AMENDING THE PROVISIONS OF ORDINANCE 1992-18 OF THE CITY, AS PREVIOUSLY AMENDED FROM TIME TO TIME AND NOW CODIFIED AS SECTION 112.10 OF THE EDGEWOOD CODE OF ORDINANCES To REVISE THE HOURS
WHEN THE RETAIL SALE OF ALCOHOLIC BEVERAGES ARE
PROHIBITED IN THE CITY
BE IT ORDAINED BY THE CITY OF EDGEWOOD, IN KENTON COUNTY, KENTUCKY, AS FOLLOWS:
WHEREAS, The provisions of Ordinance 1992-18, as previously amended from time to time, and now codified as Section 112.10 of the Edgewood Code of Ordinances now prohibits the retail sale of alcoholic beverages in the City on Sunday after 2:30 A.M and before 1 1 A.M; and
WHEREAS, the circumstances and environment of the retail sale of alcoholic beverages in the City on Sunday has substantially changed since the last amendment of ordinance 1992-18 in 2013;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF EDGEWOOD IN KENTON COUNTY, KENTUCKY, AS FOLLOWS:
SECTION 1.0 – Ordinance Amendment
Pursuant to the authority of K.R.S.241280 and 241 290, the provisions of Ordinance 1992-18 of the City, as previously amended from time to time, and now codified as Section 112.10 of the Edgewood Code of Ordinances are hereby amended to revise the hours when retail sales of alcoholic beverages are precluded in the City, all in conformity with the provisions thereof in Attachment A hereto, which is incorporated herein by reference, with the words being added underlined by a single solid line beneath them and the words being deleted included in brackets with a line through them as required by K.R.S. 83A.060 (3).
SECTION 2.0 – Provisions Severable
The provisions of this ordinance are severable; and the invalidity of any provision of this ordinance shall not affect the validity of any other provision thereof; and such other provisions shall remain in full force and effect as long as they remain valid in the absence of those provisions determined to be invalid.
Section 3.0 — Conflicting Ordinances Repealed
All other ordinances or parts of ordinances in conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict.
Section 4.0 — Effective Date
This Ordinance shall be effective as soon as possible according to law.
Section 5.0 – Publication
This ordinance shall be published online pursuant to the provisions of K.R.S. 424.145.

Section 2.0 — Times When Sales of Distilled Spirits, Wine and Malt Beverages are Prohibited
Nobody shall cause, permit, allow, aid, assist, encourage or engage in the retail sale of any distilled spirits, wine or malt beverages in the City of Edgewood, by the drink or package, during the period of time after 2:30 A.M. and before 6:00 A.M. on every day except Sunday, when such sales are prohibited during the period of time after 2:30 A.M. and before 8:00 A.M.
